SamAir\PremProxy Terms of Service
Permission is granted to temporarily download one copy of the materials on premproxy.com’s web site (hereinafter referred to as the PremProxy or Contractor) for personal, commercial or non-commercial transitory viewing. This is the grant of a license, not a transfer of title, and under this license you may not:transfer the materials to another person or “mirror” the materials on any other server. This license shall automatically terminate if you violate any of these restrictions and may be terminated by premproxy.com at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.
Customer agrees to a monthly term for Services unless otherwise agreed to in writing, by electronic mail, by instant messaging, or electronically via Provider’s website.
PremProxy does not offer subscription plans with recurring auto payments. "One-time payments" model is being used for all Services.
3.1. Making a payment for the services provided by the Contractor (PremProxy) means acceptance of the refund policy, which is set out below.
3.2. All refunds are made only by the request of the customer.
3.3. Any duplicate payment is refundable.
A duplicate payment is a payment made twice within a day for the completely same service.
By default, Contractor regards the duplicate payment as erroneous, unless otherwise stated by the buyer when contacting technical support.
Of two payments made one after the other during the day, the last payment is considered to be duplicated.
3.4. Any payment made by occasional mistake is refundable.
If the person who made the payment has used the service at least once, this payment cannot be treated as mistakenly made.
Logon to members area of Paid Proxy List Service or logon to userpage of Premium Services or (even single) connecting to"Premium UK" or "Premium USA" proxy server is treated as using of the service.
3.5. Payment for the Service may be refundable in some cases.
3.5.1. The service fee can be refunded by the request of the Customer if the Service has never used because of its unavailability during 72 hours after payment was done.
The unavailability of the Service depending on selected paid tarifs and plans means the following:
- Customer does not have access to proxy list (for the Paid Proxy List Service);
- UK Premium proxy server does not work on Contractor side (for UK Premium Proxy Service);
- USA Premium proxy server does not work on Contractor side (for USA Premium Proxy Service);
3.5.2. Effect of clause 3.5.1. does not cover cases of non-receipt of a mail with parameters for access to the Service (Welcome email) by Customer due to mail services blockings and failures.
3.6. Payments for Paid Proxy List Service are non refundable excepting issues to which the clause 3.5.1 is applied.
3.6.1. The nature of Paid Proxy List Service is providing of information about open (public) proxy servers. This information contains IP addresses and ports of Public proxy servers collected from World Wide Web.
3.6.2. This information can be used in many ways: from building server deny lists or other IP lists to SEO purposes. Thus, the guaranteed performance of public proxy servers from the paid list is not the main priority. Moreover, the Contractor (PremProxy) has nothing to do with the launch and running of these public proxy servers and, accordingly, can not in no way be responsible for the operability, stability, speed or availability of these proxy servers.
3.6.3. In accordance with the above in clauses 3.6.1. and 3.6.2., non-working of any part of the proxy servers from the proxy list is not a valid reason for a refund request, and such requests will not be considered.
